Simply put, there cannot be two Basscast podcasts in the same distribution channels, specifically the world wide web and podcast directories including iTunes and Odeo.
Unauthorized use of our trademark amounts to an infringement of our trademark rights. We request that you cease & desist in any further use of “Basscast” in association with the marketing, distribution, or identification of your podcast.
Please respond by email, indicating your intention to cease & desist the use of the trademark “Basscast”, or any confusingly similar trademark, within ten (10) calendar days from the date of this email.
We hope this issue may be resolved this way so we can avoid any further legal remedies as provided by U.S. and international law.
If we do not hear from you within ten calendar days of the date of this email, we will seek all remedies open to us, including (but not limited to): · contacting sites such as iTunes to request that they de-list your infringing podcast; · contacting the host of your web site to request that it be suspended; and · seeking compensation from you for any costs incurred by us in pursuing and enforcing our rights.
